Claim Date: 4/10/2025

“Bankers Life Securities, Inc. (BLS) received a written complaint on April 10, 2025 regarding the purchase of two annuities from the firm‘s insurance affiliate, Bankers Life and Casualty Company (BLC), as well as mutual fund purchases in a brokerage account with BLS. In the complaint, the client alleged that the financial representative‘s (FR) recommendations were not in the client‘s best interest and were a violation of the FR‘s fiduciary duty. The client further alleged that the FR‘s recommendations caused them significant unexpected tax consequences. The client requested to be reimbursed the total amount they transferred to BLS and BLC, as well as to be reimbursed for the tax liability incurred as a result of the recommendations. BLC denied the client‘s allegation regarding the first annuity, finding that this purchase was suitable and, in the client‘s best interest. The client was able to surrender the second BLC annuity, without penalty, under the free look provision of the contract. In regard to the mutual fund transactions with BLS, while the FR advised the client to speak to a tax advisor in connection with the recommended transactions and the client signed disclosure forms acknowledging that the transactions could create a taxable event, BLS agreed to cancel the mutual fund transactions, returning the clients to their original positions with no taxable consequences.”
