“The customer sent emails dated March 25 and April 1, 2020 in Spanish to Mr. Moreno in which she appears to be complaining about a loss in value of certain fixed income and preferred stock investment positions, which were sold pursuant to the customer‘s instructions received on April 1, 2020. The literal English translation of one email includes the terms “stole“ and “thief“ in reference to the firm and Mr. Moreno, which gave rise to the obligation to report the customer complaint. However, based on the firm‘s review of the complaints and the account files, it appears that no theft of funds or securities occurred, as the investment positions were sold pursuant to the customer‘s instruction and the sales proceeds were remitted in full to the customer‘s account.”
